When is a review unlawful?
Can I have a review deleted if it is only negative but does not contain any false information?
Negative reviews that contain purely subjective opinions and do not include unlawful content (such as false statements of fact or insults) generally cannot be removed. Freedom of expression protects such statements. An exception is 1-star reviews without any text. Several courts have already ruled that a negative 1-star review with no explanation, especially if submitted anonymously or under a pseudonym, can justify a removal request. The recipient cannot verify the basis of the negative review or whether the reviewer ever had any business contact with the company.
What are my chances of success?
The chances of success depend on many different factors. On the one hand, it is of course important that the deletion claim itself is clear and unambiguous. If the review is undoubtedly unlawful, then the platform’s response is also crucial. In rare exceptional cases, platforms may arbitrarily refuse to delete some reviews. In such situations, Hivelegal will reopen the out-of-court deletion process or seek legal action. Authors sometimes contact the platform independently and comment on their reviews. The platform operator is then obligated to review the matter. If the platform operator considers the author’s statement to be plausible and truthful, deletion can be refused on this basis.
How exactly does the deletion process work?
First, we examine and review the review in detail. We pay close attention to whether we classify it as unlawful or whether there is a claim for deletion for other reasons. We also assess the chances of success based on our experience. We then contact the client, present our assessment, and offer a total price for deletion. Should you wish to address multiple reviews simultaneously, this reduces our workload. We naturally also factor this time savings into our pricing policy, so you can expect tiered pricing and volume discounts. Individual reviews start at €99.00 or €149.00 plus 19% VAT.

If you accept our offer and grant us the mandate, we will draft a legal letter requesting the platform operator to delete the reviews. Depending on the platform, we will submit our letter either electronically via email or via a form/deletion request. We will then wait for a response from the platform operator or, if applicable, the author. If further comment or dispute is required, we will also handle this for you.

How long does it take for a review to be deleted?
The time until successful deletion is typically 2-4 weeks. In some cases, processing may take longer if the platform operator is overworked or the case is complex. However, our experience has shown us that large operators in particular – such as Google or Amazon – sometimes prefer to take a little longer with deletion. In legal proceedings, the process can take several months or even up to a year.
What information or evidence do I need to provide?
For a successful deletion, a plausible explanation regarding the false factual claim or the untruthful or inauthentic review, as well as a detailed legal justification for the deletion claim, is usually sufficient. However, it is still important to keep copies of customer communications, any evidence, or company information ready and make them available if necessary during the deletion process. In the event of a legal dispute, such documents must be submitted to provide the relevant evidence.

Because cost certainty and transparency are important to us, we work with flat rates for platform deletion procedures. The costs for reviews without text start at €99.00 net (per review). Reviews with text start at €149.00 net (per review). If you want to address multiple reviews simultaneously, this reduces our workload. We naturally also factor this time savings into our pricing policy, so you can expect tiered pricing and volume discounts.
Should personal action against the author or even legal proceedings be initiated, the costs will be pre-calculated and calculated accordingly. Based on this, you are free to decide whether or not to initiate legal proceedings, or whether you want to take personal action against the author.
Who bears the costs if the deletion is successful?
In the case of deletion proceedings via the platform operator (such as Google), the entrepreneur is usually left with the costs, as these are non-reimbursable. In some cases, you can check with your legal expenses insurance beforehand to see if the costs will be covered. However, the deductible must be taken into account.
In the event of personal action against the author, the legal fees can usually be reclaimed if the case is successful. This also applies if the case is successful in court.

Unfortunately, our experience shows us that some authors do not respond particularly positively to a lawyer’s request for deletion. However, in such a case, you should not be afraid to take action and assert your rights. After all, the law is on your side! If the author responds to the deletion with further negative reviews or starts a campaign, you should document all events and other defamatory activities with screenshots. It is advisable to involve a lawyer as early as possible. They can quickly and effectively put an end to the “shitstorm” and initiate further legal action for defamation.

How can you find out who left the review?
The identity of the reviewer cannot be directly and independently determined. However, criminal or legal action can be initiated to establish the identity of the author. This is particularly relevant if the content of the review constitutes defamation or insult, as this could result in criminal consequences.

Furthermore, one can also request that platform operators disclose the author if a violation of law has occurred. To be fair, most platform operators will refuse to do this and simply qoute “data protection” as a matter of principle.
